5am – A/B/C Fox chief Roger Ailes: Trump’s attack on Kelly is ‘disturbing.’ The battle between Donald Trump and Fox News is back with a vengeance. Fox wants the famously non-apologetic presidential candidate to apologize for his latest round of attacks against Megyn Kelly. “Donald Trump’s surprise and unprovoked attack on Megyn Kelly during her show last night is as unacceptable as it is disturbing,” Fox News chairman Roger Ailes said Tuesday afternoon. He added, “Donald Trump rarely apologizes, although in this case, he should.” Trump almost instantly responded — not with an apology but with a fresh shot at Kelly. And during a news conference Tuesday evening he dismissed Kelly. “I don’t care about Megyn Kelly,” he said during a news conference. “She should probably apologize to me, but I just don’t care.” Trump has been furious with the 9 p.m. host ever since she questioned him at Fox’s GOP debate on August 6.

5am – D         Hillary News:

  • Exclusive: State Dept.-released Clinton email had classified intel from 3 agencies, possibly violating Obama order. (Catherine Herridge/Fox News) – One of the emails that triggered the FBI probe into Hillary Clinton’s server contained classified intelligence from three different agencies, Fox News has learned – which could mean the State Department violated a President Obama-signed executive order by authorizing its release. That 2009 order, EO 13526, lays out the rules for “classifying, safeguarding and declassifying national security information.” It states that the authority to declassify rests with the intelligence agency that originated the information. “Information shall be declassified or downgraded by … the official who authorized the original classification … [or] the originator’s current successor,” the order says. One of the two emails that sparked the FBI probe was an April 2011 email from Clinton confidant Huma Abedin that, Fox News has learned, contained intelligence from the Defense Intelligence Agency (DIA), the National Security Agency (NSA), and the National Geospatial-Intelligence Agency (NGA), which oversees aerial imagery, including satellites.
  • Bernie Sanders surges ahead of Hillary Clinton in second striking New Hampshire poll. A second poll in less than two weeks shows Sen. Bernie Sanders (I-Vermont) leading former Secretary of State Hillary Clinton in the race for the Democratic presidential nomination in New Hampshire. Sanders leads Clinton, the presumed Democratic front-runner, by 7 points in the Granite State, according to the Public Policy Polling survey released Tuesday. A Franklin Pierce University/Boston Herald poll released almost two weeks ago also gave Sanders a 7-point lead.
  • Survey: Near Majority Wants Hillary to Stop Campaign Until Emails Settled. Growing national security questions about Hillary Clinton’s use of a private email server during her time as secretary of state are drowning out her message as a presidential candidate and causing many fellow Democrats to worry about the future of her campaign. As for voters not affiliated with either party, 46 percent agree the campaign should be suspended. Forty-five percent of all voters — but only 18 percent of Democrats — consider the national security questions raised about Clinton’s use of a private email server while serving as secretary of state to be a serious scandal, according to Rasmussen. Twenty-eight percent of likely voters consider the matter an embarrassing situation, while nearly as many say it’s no big deal.

6am – A/B/C Waitress receives rude note on receipt and no tip. It seems like everyday, there’s a new story popping up about an unhappy diner who scribbles something rude onto their receipt, or simply pens an empty “0” on the tip line. For 20-year-old Rutgers University student Jess Jones, the money she made during her summer job waitressing went towards her college tuition, so those tips meant a lot to her. On August 17th, Jones was serving a party of eight on a busy night at D’Jais Bar & Grill. After the $112.03 bill was paid for by credit card and the party had left, Jones noticed that her customers left her no tip. Instead, the just the letters “LOL” was written on the tip line of the receipt, next to the words, “1 hour for food.”

6am – E         U.S. stocks stage dramatic reversal, erasing rally and raising new fears. U.S. stocks plunged in the last hour of trading Tuesday to wipe out a day-long rally, adding fresh uncertainty to markets that had seemed to be on the rebound. The wild swing highlighted investors’ anxieties about an expansive Chinese slowdown and hinted at fault lines in a U.S. economy otherwise considered strong. The surprising setback dropped the Dow Jones industrial average more than 650 points from its midday peak, its biggest reversal since 2008, and pushed the index of 30 blue-chip stocks down 204 points, or about 1 percent, to 15,666.44.

How one CEO is urging baristas to calm customers who have stock market jitters.

If you have jitters even before you walk in the door of your favorite Starbucks, there may be some calm on the horizon. The CEO of Starbucks, Howard Schultz, reached out to his 190,000 employees and encouraged them to be extra kind to customers who might be shell-shocked over Wall Street’s wild ride Monday, The Washington Post reports. “Today’s financial market volatility, combined with great political uncertainty both at home and abroad, will undoubtedly have an effect on consumer confidence and … our customers are likely to experience an increased level of anxiety and concern,” Schultz wrote in his “Message from Howard” morning email, the Post reports. “Please recognize this and — as you always have — remember that our success is not an entitlement, but something we need to earn, every day. Let’s be very sensitive to the pressures our customers may be feeling, and do everything we can to individually and collectively exceed their expectations.”

 


7am – A/B/C Old Dominion University fraternity suspended amid uproar over suggestive signs. (Fox News) — The national office of the Sigma Nu fraternity suspended all activities at its Old Dominion University chapter Monday as it opened an investigation into three sexually suggestive banners that were hung from the front porch of the group’s off-campus house over the weekend. “The Fraternity condemns the derogatory and demeaning language used on the banners,” the fraternity’s executive director Brad Beacham said in a statement. “Such language has no place in our Fraternity or within any caring community, such as that of ODU.” Beacham vowed that any fraternity members deemed responsible for what he called the “reprehensible display” would be held accountable. The signs were hung over the weekend as newly admitted freshmen were arriving at ODU’s Norfolk campus. They read, “Rowdy and fun hope your baby girl is ready for a good time…”; “Freshman daughter drop off”, with an arrow pointing to the house’s front door; and “Go ahead and drop off mom too…”. Images of the signs were captured in a picture that was briefly posted to Facebook and preserved in a screengrab by the Huffington Post. The Facebook post has since been deleted.

  • TRAIN TERRORISM: France Formally Opens Terrorism Probe in Train Attack. French train gunman LAUGHS as he denies terrorism and says he found his guns in a children’s playground. (Daily Mail) —   Thwarted train gunman Ayoub El Khazzani has laughed at accusations he was trying to carry out a terrorist attack on the Amsterdam to Paris express, his lawyer has claimed. Morocco-born El Khazzani, 26, says he does not see why his actions on the Thalys train on Friday have caused such an outcry and insisted that he was only interested in ‘robbing the passengers’.
  • French Prosecutor: Train suspect watched jihadi video minutes before attack. (CBS) – PARIS — French authorities formally opened a terrorism investigation on Tuesday after a thwarted attack on a high-speed train last week, saying the suspected attacker had watched a radical Islamic video onboard minutes before the violence.
  • IRAN: Barack Obama calls opponents of Iran deal ‘the crazies’ White House walks back Obama’s ‘crazies’ comment. The White House on Tuesday walked back on President Obama’s comments during a Nevada fundraiser Monday night when he referred to some of his political opponents in Congress as “crazies.” Some reporters and critics immediately interpreted the “crazies” comment as referring to those opposing the Iran nuclear deal. The White House Tuesday denied that it was a reference to Iran deal opponents but admitted the president was “flip” with his language.

7am – E         D.C. mayor to ask for expanded police powers amid homicide spike. (Washington Post) — Responding to the District’s surging homicide rate, Mayor Muriel E. Bowser will ask the D.C. Council to expand law enforcement powers to make it easier for officers to search individuals on parole or probation and immediately detain anyone found in violation of the terms of release. Bowser hinted at the idea in a televised interview Tuesday, saying she would propose “closing some gaps in our laws. We have been talking about making it easier for our supervising agencies to identify and search for illegal guns that may be in the hands of a violent offender,” the mayor said. Council Chairman Phil Mendelson (D) confirmed details of the proposal.

8am – B/C     In Response to Fox Chief Ailes, Trump Promotes CNN; Sends Message to Entire MSM. (John Nolte) — In a Tuesday afternoon rapid response to Fox News chief Roger Ailes, Donald Trump conspicuously promoted the fact that CNN, a rival cable news network, will offer a live broadcast of his speech in Iowa tonight. After slamming Fox’s Megyn Kelly in the statement with “I do not think Megyn Kelly is a quality journalist,” Trump flexes his growing political star-power by promoting CNN: “I will be in Iowa tonight with my speech being live on CNN and other networks,” Trump writes. With his late night tweets, Trump once again stole the news cycle from the rest of the Republican field by reigniting his feud with Kelly — a full two weeks after everyone thought it was over. This afternoon, Ailes released a statement defending Kelly and demanding Trump apologize.

8am – D         INTERVIEW – TOM FITTON – President of Judicial Watch

  • State Dept.-released Clinton email had classified intel from 3 agencies, possibly violating Obama order. Despite this fact and despite the executive order, the State Department publicly released the email and its intelligence — which was not theirs to declassify — onto its website in May as part of the initial release of documents on the 2012 Benghazi attack. Fox News is told that in late spring, all three agencies confirmed to the intelligence community inspector general that the intelligence was classified when it was sent four years ago by Abedin to Clinton’s private account, and remains classified to this day.
  • IRS reveals existence of another Lois Lerner email account. IRS lawyer Geoffrey J. Klimas told the court that as the agency was putting together a set of documents to turn over to Judicial Watch, it realized Ms. Lerner had used yet another email account, in addition to her official one and another personal one already known to the agency. “In addition to emails to or from an email account denominated ‘Lois G. Lerner’ or ‘Lois Home,’ some emails responsive to Judicial Watch’s request may have been sent to or received from a personal email account denominated ‘Toby Miles,'” Mr. Klimas told Judge Emmet G. Sullivan, who is hearing the case. It is unclear who Toby Miles is, but Mr. Klimas said the IRS has concluded that was “a personal email account used by Lerner.” Tom Fitton, president of Judicial Watch, said it was stunning the agency was just now admitting the existence of the address.

8am – E         DC News:

  • Zoo: Panda mom not swapping in smaller cub for feeding. (AP) — The smaller of the two panda cubs drinks a special formula from a bottle in this Aug. 24 photo. The smaller cub had a birth weight of 86 grams. Its twin weighed 138 grams and is being cared for by mom, Mei Xiang. WASHINGTON (AP) — A tiny newborn panda cub is getting extra care at the National Zoo after mom Mei Xiang stopped letting animal keepers swap the smaller cub in for feedings as she cares for the larger twin, the zoo said Tuesday. Mei Xiang has the larger cub in her possession and appears to be taking very good care of it, the zoo said. Still, the cubs remain in a high-risk period. The panda team is focusing more intensely on the smaller cub because it has been away from its mother. Zoo officials said the smaller cub’s behaviors are good, but the team is concerned about the cub’s fluctuating weight. Keepers are bottle- and tube-feeding the smaller cub and because it has shown some signs of regurgitation, which can lead to aspiration, they also are administering antibiotics. Because pandas won’t usually nurse twins if left to their own devices, officials are trying to switch the cubs every four hours to allow the mother to nurse and bond with one cub at a time. Mei Xiang stopped allowing the cub swap Monday afternoon, but animal keepers will keep trying, the zoo said.
  • PETA condemns National Zoo for splitting panda twins. PETA is not pleased with the National Zoo. The animal advocacy organization released a scathing statement Tuesday condemning the National Zoo for splitting the new panda cubs and only allowing one cub to be with the mother at a time. PETA President Ingrid Newkirk denounced the separation of the twins, born Saturday, calling it a “public-relations fiasco.” “Studies show that captive giant panda cubs subjected to early removal from their mothers experience problems with behavioral development from a lack of mother-infant social stimulation,” she said in a statement. “Removing babies as if they’re nothing more than future exhibits to be preserved and treating the mother panda as simply a baby-making machine while disrespecting and disregarding her maternal instincts as well as fighting with her to remove her infants in the name of ‘animal science’ is unethical, unthinkable and wrong.”
  • Washington Monument reopens after morning elevator repairs. WASHINGTON — The Washington Monument will reopen as scheduled, after an elevator outage Tuesday night left visitors — two of whom were pregnant — stuck at the top of the structure. U.S. Park police had warned that the site would be closed Wednesday morning so that crews could make the needed fixes. But technicians were able to complete the repairs and testing early Wednesday. The monument is expected to open at 9 a.m. Park police said a problem with door contacts caused the elevator to stop working just prior to 10 p.m. Tuesday, leaving the 63 visitors at the top with no choice other than to walk down 500 feet of stairs to get out. Two pregnant women were among the visitors. Both women had to be carried down the stairs. Park police said no one was trapped in the elevator.
  • BREAKING: WDBJ7 crew involved in shooting on live TV. MONETA, VA (WWBT) – A Roanoke TV crew was involved in a shooting on live television on Wednesday morning, according to media reports. A crew from WDBJ7, the CBS affiliate in Roanoke, was reporting live around 6:45 a.m. at Bridgewater Plaza near Smith Mountain Lake. On the video you can hear seven shots fired and the photographer’s camera appears to fall to the ground while the reporter, Alison Parker, screams. Police say there were three victims, but the extent of their injuries is not yet clear, according to WSLS.
