Alimony Law Applies To Same-Sex Couples, Court Rules

WASHINGTON (WMAL)– The Virginia state Supreme Court has ruled that a Fairfax County man no longer has to pay alimony to his ex-wife — because she now lives with another woman.

Under Virginia law, alimony payments can end if the receiving spouse has been living with another person, in a marriage-like relationship, for at least a year.

This ruling clarifies that now, with same-sex marriage legal, cohabitation in a same-sex relationship is grounds for ending alimony. Previous lower court decisions had found the opposite.
