Convict in Lansdowne Baby Death Case Asks For Restricted License

WASHINGTON (WMAL) – A man serving time after killing a baby when he struck him and his mother in a Lansdowne crosswalk in 2016 said it’s been a hardship getting to work on work release. John Miller has asked a judge for a restricted license so he can drive himself between the Loudoun Adult Detention Center in Leesburg and the Virginia Golf Center in Clifton where he’s allowed to work as a golf instructor while serving his sentence.

Miller’s license was revoked after he was convicted of reckless driving and failure to yield to pedestrians Mindy Schulz and her infant son Tristan who was in a stroller.

“I find Miller’s entitled perspective insulting and alarming,” Schulz said in response to Miller’s request.

Right now two volunteers approved by the sheriff’s department have been driving Miller to work as a golf instructor according to his attorney Steven Webster.

“One of whom is his father who lives up in Hagerstown, so he has to come all the way down to Leesburg and stay here overnight so that he can get him back and forth to work for a few days,” Webster said.

Miller is allowed to take a cab, but Webster said that’s not financially feasible given that it’s a roughly 25 mile ride between the jail and golf center.

Webster said the judge has taken the matter under advisement.

Webster is hopeful the request will be granted. It’s fairly routine for courts to grant restricted licenses for people who had their licenses suspended for driving under the influence and reckless driving according to Webster. Still, he said judges do have a lot of discretion when deciding on such requests.
